You must be at least 18 years old or the legal age of majority in your jurisdiction to use our Services. By using the App, you represent and warrant that you meet this requirement.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for personal, non-commercial use in connection with your LYKYN Device.

To access and use the App, you must create an account and connect your Device via Wi-Fi. You agree to provide accurate, current, and complete information during registration and to update it as needed.

You are responsible for safeguarding your login credentials. LYKYN is not liable for any unauthorized access to your account.

We do not collect or access your device's location, microphone, or camera.

Your data may be stored and processed via third-party cloud services, including Amazon Web Services (AWS). For more information on how we protect and use your data, please refer to our Privacy Policy.

While currently disabled, future versions of the App may allow you to upload content such as grow logs, photos, or notes. You retain ownership of your content, but you grant LYKYN a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content for service improvement, support, or promotional purposes.

You agree not to submit content that:

All intellectual property rights in the App, Devices, software, trademarks, designs, and content are owned by or licensed to LYKYN. Except for the limited rights granted in these Terms, you receive no license or ownership rights in or to any LYKYN intellectual property.

We reserve the right to update or discontinue any part of the App or Services at any time, including firmware, features, or compatibility. We may also revise these Terms, and your continued use after such revisions constitutes acceptance.

The App and Devices are provided "as-is" and "as available." LYKYN disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, reliability, or non-infringement.

We do not guarantee specific mushroom growth results or device performance in uncontrolled environments. Users are solely responsible for proper device setup, environmental maintenance, and growing practices.

To the fullest extent permitted by law, LYKYN is not liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the App or Devices — including loss of crops, revenue, or data — even if we have been advised of the possibility of such damages.

Our total liability will not exceed the amount paid by you (if any) for the Device or App giving rise to the claim.

You agree to indemnify and hold harmless LYKYN, its affiliates, and employees from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Services, your content, or your violation of these Terms.

You agree not to use, export, or re-export the App or Devices in violation of any U.S. or international export control laws or regulations.

We may terminate or suspend your access to the App or Services, without notice, if we reasonably believe you have violated these Terms or pose a threat to the safety, integrity, or reputation of our brand or user community.

If any part of these Terms is held to be unenforceable, that portion shall be construed to reflect the parties' original intent, and the remaining provisions shall remain in full force and effect.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and LYKYN and supersede all prior understandings or agreements.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any dispute arising out of these Terms shall be resolved in the courts located in Sonoma County, California.
